Terms of Service

The contract between you and Valofair.

01.Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you ("User", "you") and Valofair ("we", "us", "our") and govern your access to and use of the Valofair platform, websites, applications and related services (the "Services").

By creating an account or using the Services, you confirm that you are at least 18 years old, have the legal capacity to enter into a contract, and accept these Terms in full. If you do not agree, you must not use the Services.

02.Description of the Services

Valofair is a technology platform that helps vehicle owners in the European Union challenge underpayments from auto insurers. We provide:

  • Independent valuation analyses based on comparable market data.
  • AI-assisted review of insurer offers and supporting documentation.
  • Drafting of dispute correspondence and negotiation support.
  • Optional escalation to qualified experts and lawyers in our partner network.

Valofair is not an insurance company, claims regulator, or law firm. We do not underwrite policies or guarantee any particular dispute outcome.

03.Eligibility and Accounts

To use most of the Services you must register an account with accurate, current and complete information. You are responsible for safeguarding your credentials and for all activity under your account.

You must promptly notify us at security@valofair.com if you suspect unauthorised use of your account. We may suspend or terminate accounts that violate these Terms or applicable law.

04.User Obligations

When using the Services you agree to:

  • Provide truthful, accurate and complete information about your vehicle, accident, and insurer.
  • Upload only documents you have the right to share.
  • Not misuse the Services, attempt to bypass security, or use them for unlawful purposes.
  • Comply with all applicable laws, including consumer protection, data protection and tax laws.

You are solely responsible for the accuracy of the information you submit. False or misleading information may invalidate your dispute and may constitute fraud.

05.Pricing and Payment

Valofair offers three pricing models:

  • Success Fee – no upfront cost; we charge a percentage of the additional amount recovered above the insurer offer.
  • Hybrid – a small upfront fee combined with a reduced success fee.
  • Fixed Fee – a one-off price agreed before the work begins.

The exact percentages, fees and currency will be displayed before you accept a pricing model and are confirmed in your dashboard. Payments are processed by Stripe; you authorise us and Stripe to charge the agreed amounts to your selected payment method. All fees are inclusive of applicable VAT unless stated otherwise.

06.No Guarantee of Outcome

Insurance disputes depend on facts, evidence, applicable law and the conduct of the insurer. While we use industry expertise and data to maximise your recovery, we cannot and do not guarantee any specific outcome, amount or timeline. Past results are not indicative of future performance.

07.Right of Withdrawal (Consumers)

If you are a consumer in the EU, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which the contract is concluded.

To exercise the right of withdrawal, you must inform us by an unequivocal statement (e.g. an email to support@valofair.com). If you request that we begin the Services during the withdrawal period, you may be required to pay an amount proportionate to the work performed.

08.Intellectual Property

All software, designs, text, graphics, models and other content provided through the Services are owned by Valofair or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Services for the purposes set out in these Terms.

You retain ownership of the content you upload but grant us a worldwide, royalty-free licence to use it for the purpose of providing the Services and improving our models in aggregated and anonymised form.

09.Limitation of Liability

To the maximum extent permitted by law, Valofair shall not be liable for indirect, incidental, special or consequential damages, or for loss of profits, revenues, data, or goodwill arising out of or in connection with the Services. Our total aggregate liability for any claim arising out of these Terms shall not exceed the greater of (a) the fees you paid to us in the 12 months preceding the event giving rise to the claim, or (b) €500.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.

10.Termination

You may close your account at any time from your dashboard or by contacting support@valofair.com. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or if required by law. Provisions that by their nature should survive termination (including liability, intellectual property and dispute resolution) shall remain in force.

11.Governing Law and Disputes

These Terms are governed by the laws of the European Union and, where applicable, the country of your habitual residence. Disputes shall first be addressed through good-faith negotiation. If unresolved, you may bring proceedings before the competent courts of your country of residence or use the European Commission Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

12.Changes to these Terms

We may update these Terms to reflect changes in our Services or legal requirements. Material changes will be notified by email or through a notice on the platform at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
