Austria
Austria's VVG is explicitly pro-policyholder: its provisions can only be modified in the consumer's favour. Free choice of repair shop, full file access, and compound interest on late payments make Austria an underrated jurisdiction for insurance disputes.

Your key rights
Pro-policyholder VVG
VVG provisions may only be altered to the policyholder's benefit, never to their detriment. Many insurer terms that try to do otherwise are simply unenforceable.
Direct action against the at-fault insurer
You can claim directly against the at-fault driver's insurer without going through the at-fault driver themselves.
Free choice of repair shop
You decide where to repair. The insurer cannot mandate a specific garage.
Right to the full claim file
You may inspect every document on which the insurer based its decision.
Compound interest on late payments
Late payments attract compound interest, creating a strong incentive for the insurer to pay on time.
Conciliation services since 2016
Government-recognised conciliation bodies offer free or low-cost dispute resolution before court proceedings.
3 years (general limitation period)
ABGB §1489 — three years from the date the harmed party knew (or should have known) of the loss and the responsible party.
Free conciliation. Recommendations are not legally binding but carry significant weight.
