Germany

Germany has one of the strongest pro-policyholder regimes in Europe for total-loss settlements. You have the right to commission an independent Gutachter, the at-fault insurer pays for it in liability claims, and the Versicherungsombudsmann's decisions up to €100,000 are binding on the insurer.

Your key rights

  • Independent Gutachter at the insurer's cost

    In third-party liability claims you have the legal right to commission an independent Kfz-Sachverständiger (assessor). The at-fault driver's insurer must reimburse the assessment fees as part of the claim.

  • Insurer must contest in court — not ignore

    If the insurer disagrees with your Gutachter's valuation, they cannot simply pay less. They must either accept it or argue their case in court.

  • Right to keep and repair (Integritätsinteresse)

    Even when the insurer declares a Totalschaden, you may choose to keep and repair the vehicle. The insurer pays the difference between pre-accident market value and residual value — within the 130% rule established by the BGH.

  • Compensation beyond the vehicle value

    You can also recover merkantiler Minderwert (loss in value), Mietwagen (rental car, typically 14 days), expert fees, towing, plus pain and suffering if you were injured.

  • Replacement value, not book value

    Compensation is based on the local market replacement value (Wiederbeschaffungswert) of a comparable vehicle, not Schwacke book value or trade-in price.

  • Versicherungsombudsmann — binding up to €100,000

    Free, independent dispute resolution. Decisions up to €100,000 are binding on the insurer (you may still go to court if unhappy).

Time to act

3 years from the end of the year in which the claim arose

The general 3-year limitation under §195 BGB runs from the end of the calendar year in which the claim arose and you became aware of it. Liability claims may have a longer limitation period of 30 years for the underlying damages.
