Since July 2023 the Consumer Duty obliges firms to deliver fair value, including in claims settlements — and the Financial Ombudsman Service can issue binding awards up to £430,000.

  • FCA Consumer Duty (since July 2023)

    Motor insurers must deliver good outcomes for retail customers — including fair value at claim settlement. The FCA has explicitly named total-loss undervaluation as a Duty issue.

  • Fair market value, not lowest market value

    The FOS standard is fair market value: a like-for-like replacement at the date of loss. Insurers cannot anchor the offer to the cheapest example or to a trade-in figure.

  • Data Subject Access Request (DSAR)

    You can demand the full data and methodology used to value your vehicle, including the comparable adverts the insurer relied on. The insurer must respond within one month under UK GDPR.

  • Independent valuation

    Commission your own engineer's report, or use industry guides (Glass's, CAP, Parkers) plus Auto Trader / Motors / dealer listings to evidence a higher figure.

  • Financial Ombudsman Service — binding up to £430,000

    If your complaint is not resolved within 8 weeks, escalate to the FOS for free. From April 2024 binding awards can reach £430,000. The FOS has consistently overturned lowball total-loss offers.

  • Systemic underpayment confirmed

    The FCA's 2023 review found systemic underpayment on motor total-loss settlements — Admiral alone set aside £50M for redress. Your claim sits in this regulatory context.

Limitation Act 1980 (E&W) and Prescription and Limitation (Scotland) Act 1973. The clock starts at the date of breach (typically when the inadequate offer is made or the deadline missed).
