The CBI's revised Code (in force from 24 March 2026) reinforces obligations on fair value, vulnerable-customer treatment and clear claims communication.
Right to challenge the valuation
You are not obliged to accept the insurer's first offer. You can commission an independent assessment and present comparable market evidence.
Financial Services and Pensions Ombudsman (FSPO)
Insurance is the second-largest category of FSPO complaints — 2,142 in 2025, up 18% on 2024. The FSPO's mediation track resolves around 41% of complaints, free of charge.
Court tiers
District Court hears claims up to €15,000; Circuit Court up to €75,000. Arbitration clauses are not binding for claims under €5,000 on non-negotiated policies.
Consumer Insurance Contracts Act 2019
Statutory duties of utmost good faith now cut both ways. The insurer must handle your claim with reasonable care and skill and pay within a reasonable time.
6 years from the date of the event
Statute of Limitations 1957 (as amended). For breach of contract, six years from the date of breach.
