Indemnity principle
You must be put back, financially, to where you stood before the loss. Underpayment is as much a breach of the indemnity principle as overpayment would be.
Right to dispute the valuation
You can challenge the insurer's valuation with independent evidence. AutoScout24.nl, Marktplaats listings and ANWB valuations are commonly accepted comparables.
Kifid mediation and binding decisions
Free mediation through the Kifid Ombudsman. If not resolved, the Kifid Disputes Committee (€50 fee) can issue decisions that are binding on the insurer if they signed up to binding arbitration.
Statutory interest on delayed payment
Insurers owe statutory interest on a delayed valid claim payment, running for the entire period of default.
Waarborgfonds Motorverkeer
If the at-fault driver is uninsured, the Dutch Motor Traffic Guarantee Fund covers your loss.
3 years from the date the policyholder became aware of the claimable event
Article 7:942 BW — three years from awareness, with the limitation period interrupted by a written notice from the insurer that it rejects the claim.
